THE NYPD PROCEDURE FOR ASSAULT ARRESTS

When an assault is reported to the NYPD certain procedures must be followed. Both parties must be interviewed seperately by the officer and a valid identification of the defendant must be made. In addition, all of the relevant witnesses in the area must be interviewed. As a former prosecutor I can attest to the fact thast the NYPD routinely fails to take these essential steps. Usually, they arrest the person who won the fight. They do not consider the possibility of self defense nor do they have an interest in thoroughly examining the case. As long as they can make an easy arrest, they do it and let the Courts figure it out.
